66/09 MATTERS ARISING FROM THE MINUTES
a) Reception for Parish and Town Councils – 17th April

67/09 PUBLIC QUESTIONS AND COMMENTS
a) Planning Application – 09/00596/FUL – Red Lodge, Belmore Lane, Owslebury
The owner of the property talked through the proposals. He explained that they were hoping to re-open the old entrance to the property, as they would prefer to be part of the community. This would also enable them to access their property from a wider access road with improved sight lines.
Mr Emmans said that the current access had only recently been opened, permission given by himself onto a lane which he owned. He didn’t mind either way.
b) Planning Application – 09/00661/FUL – Mapledown, Warley Lane, Morestead
The owner of the property confirmed that there were two aspects to the planning application: -
Garden hedge – the owner confirmed that originally there was a line of conifers. They did not believe them to be in character with the area so they removed them and replaced them with a hedgerow of a suggested mix. One of their neighbours told them they were planting illegally so they stopped planting and sought clarification. There are two lines of hedgerow, either side of the fence and the idea is that long term the hedgerow will cover the fence.
Owing to a slight change in their circumstances they are looking to build a single storey side extension to the property. The plans for the previous application for this extension, refused, were drawn up by the owner and didn’t show the correct dimensions. The current plans have been drawn up professionally. The owner believes it should be screened by the trees and not seen from the road.
c) Planning Application – 09/00606/LDC – Stoneycroft, Hurst Farm, Hurst Lane, Owslebury
Mr Chapman explained that this application was similar to others in the close. The purpose being to confirm the legal position of the land to ensure that if and when the property was sold there would be no problems with the designation of the land.
68/09 HIGHWAYS
a) Virtual Footpaths
Cllr Meads reported that she had met with Mr David White, Head Teacher of Owslebury School and Mandy Ware, HCC and they had discussed virtual footpaths around the School Travel Plan. Mr White confirmed he was keen to support the Parish Council whatever direction we wanted to proceed and would support a virtual footpath if it reduced the speed of traffic. Mandy Ware confirmed a virtual footpath looked similar to a cycle lane.
There would need to be a feasibility study, as excluding the virtual footpath there has to be sufficient room for two small cars to pass. Cllr Meads believed that that between The Ship and The Recreation Ground this would not always be possible. The next step would be for the Parish Council to decide whether they felt a feasibility study would be worthwhile. Cllr Meads only concern is that a VP might give a false sense of security, though she understands New Town has recently installed a VP, which is working well.

b) Hurst Lane
Cllr Manship confirmed a report and invoice had been received from Mr Bould following his visit. Cllr Manship was concerned that whilst the report suggests kerbing to prevent further deterioration to the banks, it does not suggest ways forward to relieve the flooding problems at the bottom of Hurst Lane, near the junction with Lower Baybridge Lane outside Marwell Wildlife and outside Whaddon House.

69/09 RIGHTS OF WAY
a) Red Lane
Cllr Chase confirmed that whilst in discussion with HCC regarding the Traveller, a keyed barrier had been suggested. The Clerk confirmed that the Council’s letter to HCC requesting support with this had been forwarded to Liz Giles. Liz Giles had since notified the Clerk that from April 1st she would be taking a sideways move to another geographic area following a restructure. She was uncertain who would be taking over RoW responsibility for Owslebury.

70/09 PARISH COUNCIL INSURANCE – RENEWAL
The Council agreed that the quotation to renew the Council’s insurance with Allianz should be accepted.
The Chairman reported that the concrete lampposts in Beach Grove, owned by the Parish Council had been removed from the Insurance in 2002. Mr Julian Higgins, Head of Lighting, HCC has asked the Council to insure the lampposts for a sum of £1000 each. This sum would cover most of the replacement cost if required. Mr Higgins has confirmed that HCC will undertake the repair / replacement, re-link with the electricity supply and cover any cost over and above this amount. The cost to the Parish Council to insure the lampposts for £1000 each is £13.36 each. The Council agreed.

72/09 ENFORCEMENT
The Chairman reported to the Council that he had met with Neil Marsh, Head of Enforcement - WCC, Cllr Ruffell and the Clerk on 8th May to discuss the current position regarding all open enforcement cases. As mentioned in his Annual Report he was pleased to report that, evident at this last meeting, enforcement enquiries were now being progressed.
Cllr Chapman asked the position with regard to Marwell Yard (ref. 08/00097/COU). The Clerk confirmed that HCC were concerned about the site being used as a waste transfer station and that they had agreed with WCC that they would progress both enforcement cases together for this site. At a site visit HCC had given Essex Utilities three options:
- to leave the site; to face enforcement; to apply for retrospective planning application for storage and a temporary waste transfer station. HCC expected Essex Utilities to apply imminently for a retrospective planning application and this would go out to consultation, including the Parish Council.
A difference of opinion ensued as to whether a stop notice should have been issued with immediate effect or whether the Enforcement Officer should be supported in handling the case in the manner she had explained to the Clerk. Further to this discussion Cllr Chapman and Cllr Tull proposed and seconded that a letter of complaint should be sent to the Chief Executive covering Enforcement in HCC, with a copy to Cllr Mason, that a stop notice had not and should be issued to Marwell Yard with immediate effect. Cllr Page and Cllr Chase supported this.
